A trademark is a sign used to distinguish goods and services of different organizations and individuals. The owner of a trademark is an organization or individual that has been granted a certificate of protection by a competent authority or has an internationally registered trademark recognized by a competent authority or has a famous trademark. An organization or individual that is granted a certificate of trademark protection will have full ownership of that trademark, including the right to transfer the right to use the trademark. Vietnamese law on the subject, content, and validity of a trademark transfer contract still has some points that are not compatible with TRIPS and CPTPP, so it is necessary to study, amend, and supplement it appropriately to serve socio-economic development.
